Alikai Roofing Services Pty Ltd Terms & Conditions Contract
Alikai Roofing Services Pty Ltd agrees to complete the work set out overleaf/quote/work order.
- A deposit is required upon acceptance of this quotation/contract. The deposit amount is outlined on each individual quotation. Upon clearance of the deposit payment, a commencement date for the work will be given and scheduling of work will commence.
- Once accepted, the quote is a fixed agreed price for the work to be carried out and will not be negotiable at the completion of works. The work will be clearly stated on the quote. If the scope of works is not on the quote, it will not be carried out. In the event of a variation to the quoted scope of works for unforeseen reasons, the customer will be notified as soon as possible.
- The balance of the quotation/contract price is strictly to be paid on the day the repair or restoration work is completed.
- The customer agrees to supply electrical power and water as reasonably required by Alikai Roofing Services.
- All power and water charges incurred in relation to the work will be borne by the customer.
- Cancellation of work by the customer will result in the forfeiture of any deposit money paid, subject to the expiry of any applicable cooling-off period, including materials or supplies ordered and work completed to date.
- Alikai Roofing Services will not be held responsible for any delays caused by weather or other conditions.
- Alikai Roofing Services reserves the right to cancel this contract due to unforeseen circumstances at its absolute discretion.
- No responsibility will be accepted for damage to vehicles parked on the property, in adjoining driveways or on the street immediately adjoining the premises during the works. The customer is responsible for ensuring that all vehicles belonging to themselves, occupants and visitors are removed from the work area before commencement and for notifying neighbours so that vehicles likely to be affected can also be relocated where practicable.
- No responsibility can be taken for damage caused to patios, gazebos, shade cloths or roofs during the restoration process where the structure is found to be unsound or is a skillion roof without adequate fall. If shade cloth needs to be moved to complete the work, this is the owner’s responsibility and risk.
- Alikai Roofing Services takes no responsibility for faulty tile clips and is not liable for any resulting damage. Due to age, some roof tiles may be discontinued and unavailable for purchase. Quality-inspected second-hand tiles sourced for the job carry a six-month warranty from the supplier.
- No responsibility can be taken if rust returns. Treating rusty screws or sheets is a rust treatment and is preventative, not a cure.
- No responsibility can be taken for damage to guttering during the restoration or cleaning process where gutters are found to be rusty or weathered due to age.
- Alikai Roofing Services does not accept responsibility and is not liable for leaks, damage or associated costs resulting from storms, extreme weather or acts of God.
- Due to age and deterioration, any damage to the roof, surface or other fixtures during cleaning is not the responsibility of Alikai Roofing Services.
- Alikai Roofing Services warrants that the best workmanship and materials have been employed. Upon receipt of full payment, workmanship is guaranteed for two years from the completion date. Services valued under $3,300 have a six-month workmanship warranty upon receipt of full payment.
- Alikai Roofing Services provides recommended cleaning procedures. If these procedures are not followed, Alikai Roofing Services will not be liable for any loss and reserves the right to void the warranty.
- After cleaning, the true condition of the tile or Colorbond tin is revealed. Due to age, deterioration and sun damage, some roof surfaces may be compromised or weathered, resulting in variations in texture and the appearance of the finished painted roof. Some roofs may display a duller, flat, uneven or patchy satin finish. Different lighting conditions, including sunlight, may affect the finished appearance.
- For previously painted roofs, cleaning may remove some existing paint while some paint may remain. This may affect the appearance of the finished painted roof and may result in a duller, flat, uneven or patchy satin finish.
- Any warranty does not apply to products that have been subject to misuse, neglect, accident or alteration by the customer or any other authorised or unauthorised person or thing.
- The Alikai Roofing Services warranty does not cover leaks caused by rain, hail, snow or acts of God. A call-out fee of $150 applies, together with any costs associated with purchasing or supplying materials required to rectify the reported leaks. Where a leak is caused by a pre-existing issue unrelated to the restoration or repair process, all costs will be borne by the customer.
- The Alikai Roofing Services warranty does not cover mould growth. Regular maintenance by qualified tradespeople should include cleaning the roof with tap-water pressure and rinsing it with a broom every 12 months to remove bird droppings and reduce lichen, dirt, mould growth and oxidisation.
- Any warranty is subject to the quotation and the manufacturer’s guidelines and conditions.
- These terms and conditions are to be read in conjunction with any warranty provided by Alikai Roofing Services.
- Colour selection is limited to the colour chart provided by Alikai Roofing Services.
- If the roof has no sarking or damaged sarking, water penetration may occur during the cleaning process or due to acts of God. These circumstances are outside the control of Alikai Roofing Services.
- Alikai Roofing Services will not be liable for the failure of previous coatings, including rust-prevention coatings and third-party flexible pointing.
- The customer agrees that they and any unauthorised person will not climb onto the roof, enter the work area or use Alikai Roofing Services ladders or equipment while work is in progress. Alikai Roofing Services will not be liable for damage caused by anyone walking on the roof, and doing so will void any warranty.
- Alikai Roofing Services reserves the right to charge interest calculated daily at 10% per annum on overdue payments.
- If any provision of these terms and conditions is invalid, void, illegal or unenforceable, the validity, existence, legality and enforceability of the remaining provisions will not be affected, prejudiced or impaired.
- These terms and conditions, and any contract to which they apply, may be changed from time to time. They are governed by the laws of New South Wales and are subject to the jurisdiction of the courts of New South Wales.
